Terms & Conditions

 

• All and any business under taken by Magnum Cars & Carriages ('MCC') shall be transacted solely on the conditions herein set out. Each condition shall be deemed to be incorporated in and shall be a condition of any agreement between MCC and the customer ('hirer'). MCC's acceptance of the hirer's order is conditional on the hirer agreeing to the contract subject to these terms and conditions of service to the exclusion of all others.

• By placing a booking with MCC for services the hirer is presumed to have agreed to these terms and conditions of sale without modification. The unenforceability or invalidity of one or more of these terms and conditions or part thereof shall not affect the enforceability or validity of any other term and condition or remainder thereof.

• It is a condition of this agreement that invoices shall be paid in full within 21 days of issue thereof. Should any invoice not be paid within 21 days any outstanding invoices shall immediately become due and payable, and shall bear interest on the balance of such monies due from time to time at the rate of 3% per month until payment is received by the company in respect thereof.

• MCC reserves the right to charge the hirer any outstanding sum(s) on his/her credit/debit card (which is on file with MCC or has been used to make previous payments), if the hirer fails to acknowledge MCC's reasonable requests for any amount that is outstanding.

• The company accepts no responsibility for any delays howsoever caused.

• The driver will drive at reasonable speeds according to his judgement of road conditions and traffic at any particular time.

• When a hirer desires to travel to a particular place, the driver will, unless otherwise instructed by the Company, or the hirer, travel by the route which is, in his opinion, the shortest and most convenient for motoring. No allowance will be made to the hirer to dispute the route taken once the journery has come to an end.

• The hirer will be liable to pay the charges in full upon completion of the journey.

• Alternative methods of payment can be arranged, subject to management's discretion, however, any issues pertaining to payment must be clarified by the hirer before making the booking. Any change of destination not agreed between the hirer and driver/MCC beforehand may result in an additional charge to the hirer.

• All bookings are subject to car park charges and waiting time charges (charged on 15 minute increments).

• All credit/debit card payments are subject to a 5% surcharge.

• If the hirer fails to appear at the time and place designated as the pickup point, all monies paid will be deemed non refundable, unless a change of venue has been arranged with MCC with sufficient notice.

• Airport pickup fares are inclusive of parking and up to 1 hour free waiting time after the flight has landed, after which the hirer will be charged £5 for every 15 minutes as waiting charge.

• The consumption of food and beverages is strictly prohibited in MCC's vehicles at all times with the exception of any such items which are provided by MCC.

• Any damage and/or loss (to the driver or the vehicle) eminating from the customer(s) being sick in the vehicle as a result of, but not limited to, the consumption of alcohol will be penalized to the fixed amount of £100. Any aggravated damage and/or loss will be quantified subject to the damage/loss created.

• Smoking is prohibited in all of MCC's vehicles, in accordance with the UK laws.

• Any requests for specific vehicle(s) must be confirmed by the hirer during the booking process, however, MCC reserves the right to change vehicle or driver at any time necessary.

• A reasonable amount of ordinary passenger luggage is allowed, however luggage which in the opinion of the driver amounts to being excessive will be carried only upon the discretion of the driver and is subject to additional charge..

• MCC accepts no responsibility for any loss or damage to any luggage or property carried in or on the car, unless such loss or damage is a direct result of negligence by MCC or one of it's drivers.

• MCC reserves the right to invoice the client with a charge unless a cancellation has been received before allocation of vehicle and driver to the job.

• MCC reserves the right to request any such passenger(s) to disembark from its vehicles, as is seen fit by it's management and drivers.

• Every effort will be made to carry out the booking but its due performance is subject to cancellation by us or to such variation that we may find necessary, or as a result of inability to secure drivers and/or cars, or as a result of any act of god, war, strike, lockout or any labour dispute, fire, flood, drought, legislation or other cause(s) beyond our control.

• These terms and conditions are governed by English law.

• MCC reserves the right to alter/change these terms and conditions at any time it deems appropriate.
